Three prominent YouTube channels filed federal lawsuits claiming Amazon illegally scraped millions of videos to train its Nova Reel text-to-video AI model, marking the latest battleground in generative AI's copyright wars.

The complaint landed in Seattle federal court last Thursday, with h3h3 Productions and two other YouTube creators alleging Amazon deployed automated tools to bypass YouTube's technical protections. According to the filing reported by Law360, Amazon used virtual machines and rotating IP addresses to evade detection while harvesting copyrighted content.

The case tests whether platform terms of service and DMCA anti-circumvention rules can protect creators from having their work fed into commercial AI systems. The answer will shape how tech giants source training data as the generative video race intensifies.

The plaintiffs claim Amazon violated the Digital Millennium Copyright Act by circumventing YouTube's digital locks. MediaPost reports the creators argue that public availability on YouTube doesn't grant Amazon permission to extract and commercialize their content through AI training pipelines.

Amazon declined to comment on the litigation, according to KING 5's coverage.

The timing matters. Amazon announced Nova Reel in December as part of its push to compete with OpenAI's Sora and Google's Veo. The lawsuit suggests Amazon may have accelerated its video AI progress by harvesting existing content rather than licensing it or generating original training material.

Amazon isn't alone in the crosshairs. MacRumors reports the same three YouTube channels simultaneously filed a class-action suit against Apple, alleging similar DMCA violations for AI training. The coordinated legal action signals creators are organizing to challenge what they see as systematic appropriation of their work.

The technical methods alleged in the complaint paint a picture of deliberate evasion. According to Hoodline's reporting, Amazon allegedly used rotating IP addresses and virtual machines specifically to bypass YouTube's rate limiting and bot detection. Plaintiffs characterize these techniques as breaking digital locks, going beyond simple web scraping.

This echoes the moment in 2023 when visual artists first sued Stability AI over Stable Diffusion's training data. Those cases established the playbook: prove the defendant accessed copyrighted works, show they circumvented protections, and argue fair use doesn't cover commercial AI training.

The legal environment has shifted dramatically since then. Apify reports that over 70 copyright lawsuits have been filed against AI companies by early 2026, with courts increasingly skeptical of broad fair use claims for commercial AI products.

The plaintiffs argue in their filing that the public availability argument is particularly weak here. They contend that posting videos on YouTube with specific terms of service creates a limited license that doesn't extend to competitive AI projects.

The stakes go further than these specific creators. YouTube hosts over 800 million videos, representing decades of human creativity and labor. If courts rule that platforms' terms of service can't prevent AI scraping, it could trigger a massive shift in how creators distribute their work.

Video creators may need to watermark content or use technical protections beyond platform defaults. AI companies might face pressure to disclose training data sources and prove licensing. Platform terms of service could require explicit anti-AI-training clauses to have legal weight. The DMCA's anti-circumvention provisions may become the primary defense against AI data harvesting. Creators could organize into collectives to negotiate AI training licenses directly.

The cases now move to discovery, where the plaintiffs will look for evidence of exactly how Amazon and Apple obtained their training data. That process could reveal whether other major tech companies employed similar tactics, potentially expanding the litigation.

One question remains unresolved: if circumventing a platform's bot detection violates the DMCA, does viewing any website with an ad blocker become legally questionable? The boundary between automation and circumvention has never been fuzzier.
